Terms of Use

1. Agreement

These Terms of Use (“Terms”) are a binding agreement between you and Quantam Forge (“we”, “us”, or “our”) regarding your use of the Luminous AI mobile application (the “App”).

By downloading, accessing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. The App

Luminous AI is an on-device background remover and photo editing tool. Features may include background removal (Apple Vision on iOS 17+, ML Kit on Android), background replacement (bundled scenes and an optional downloadable catalog), edge refine, local enhance/upscale, export, share, local projects, batch processing (where available), and optional paid upgrades (Luminous Pro).

Features, quotas, and availability may change over time via app updates or remote configuration. Some features depend on device capability, OS permissions, or network access (for example the Android segmentation model, optional scene downloads, ads, analytics, or restoring purchases).

3. Eligibility

You must be at least 13 years old (or the minimum digital consent age in your country) to use the App. If you are under the age of majority where you live, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

4. License to use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal or internal business use, in accordance with these Terms and any applicable store terms (Google Play / App Store).

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer or attempt to extract source code except where local law allows
• Remove proprietary notices or circumvent access, quota, or payment controls
• Use the App to build a competing service that relies on unauthorized access to our software

5. Your content

You retain ownership of photos and other content you import into or create with the App (“Your Content”). You are responsible for having all rights needed to use Your Content and for ensuring it does not violate law or third-party rights.

Processing for cutouts and edits is designed to happen on your device. You decide whether to save, share, or delete results. We do not claim ownership of Your Content.

6. Purchases & subscriptions

Optional paid features (including Luminous Pro subscriptions and any trial offers shown in the App) are sold through Google Play Billing and/or the Apple App Store. Prices, trial length, and plan availability are shown in the App and/or store listing and may vary by region.

• Payment is charged to your store account at confirmation of purchase (or after a free trial, if applicable).
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period (or as required by the store).
• Manage or cancel in your Google Play or Apple ID subscription settings.
• Refunds are handled by Google or Apple under their policies; contact the store for billing disputes.

7. Free tier & advertising

The free experience may include daily removal quotas, standard export limits, and advertising (banner, native, interstitial, rewarded, app-open — not on the editor canvas). Rewarded ads may temporarily unlock extras. Quotas and ad placement may change. Luminous Pro removes ads according to the benefits of your active plan.

8. Acceptable use

You agree not to use the App to:

• Violate any law or third-party rights (including copyright, privacy, or publicity)
• Create or distribute harmful, illegal, or deceptive content
• Interfere with or disrupt the App, related services, or other users
• Abuse support channels, automated systems, or store review processes with fraud or spam

9. AI results & accuracy

Background removal and related tools use automated models. Results may be imperfect (for example hair, transparent objects, or complex edges). You are responsible for reviewing outputs before publishing or commercial use. The App is provided as a creative tool — not a guarantee of perfect segmentation on every image.

10. Intellectual property

The App, including its software, design, branding, and documentation, is owned by Quantam Forge or its licensors. These Terms do not transfer any ownership rights to you except the limited license in section 4.

11. Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CUTOUT RESULTS WILL MEET YOUR EXPECTATIONS.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUANTAM FORGE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

13. Termination

You may stop using the App at any time by uninstalling it and canceling any active subscriptions via the store. We may suspend or terminate access if you materially breach these Terms. Sections that by nature should survive (including ownership, disclaimers, and liability limits) will survive termination.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the App after an update means you accept the revised Terms. If you do not agree, stop using the App and cancel any subscription.
